FIMA Alfa d.o.o., following its good practice intentions, enables the use of the fima.com2 portal services and contents.
fima.com2 portal includes its own contents, advertisers' contents of contents of external web sites and portals.
Everyone enjoys the right to use fima.com2 portal services and contents free of charge, provided he/she does not breach provisions of these Terms of Use.
The user of fima.com2 portal is considered to be every individual that uses portal's services and contents, regardless of the fact that registration procedure took place, or not.
By registration and/or by using fima.com2 portal contents each user shall accept the conditions below.
During the registration procedure, FIMA Alfa d.o.o. shall send this Terms of Use to any potential User, to the e-mail given by the User (contact e-mail), and the potential User shall be allowed to complete the registration procedure only upon acceptance of these Terms of Use to receive the status of fima.com2 portal Registered Services and Contents User.
If, for whatever reason, the User considers these conditions unacceptable, he/she should not use fima.com2 portal contents, as they apply to a non-registered user as well.
Options to use fima.com2 portal services and contents offered by FIMA Alfa d.o.o. shall be considered a general quotation i.e. proposal for signing the contract about using portal services and contents, directed to an indefinite number of persons.
All persons using the stated portal shall be considered to have accepted the quotation prior to the use of the portal content and the contract about using portal services and contents shall, at the same time, be considered signed.
Terms of use which are the integral part of this Contract are those comprised by this Contract and available to all users of services and contents on this portal. Furthermore, all persons using contents of this portal shall be subject to these Terms of Use, as they have been made available publicly on the home page of the portal and also introduced with them or should have been introduced with them at the time of signing this contract.
Every person that uses the contents of fima.com² portal is bound by these Terms of Use since he/she is introduced with them or should have been introduced with them at the time of signing this contract.
FIMA Alfa d.o.o. enjoys the right to modify these Terms of Use any time. In such case, the relating modification shall be published on the portal notification board and sent via e-mail to registered users to their contact e-mail address.
If the User still uses the portal content after modifications have taken place, he/she shall be considered acquainted with the stated modifications, shall be considered to accept them and shall be subject to them. Therefore, it is the User's responsibility to regularly check for modifications published on the portal notification board and his/her contact e-mail, and keep updated.
FIMA Alfa d.o.o., as well as all companies belonging to the FIMA business system (hereinafter: the FIMA business system members), whose contents have been incorporated into fima.com2 portal pages, shall have all copyrights relating to their own contents.
Unauthorized use of the stated contents shall be considered breach of copyrights, and in such case FIMA Alfa d.o.o. or the FIMA business system members shall use all measures of legal protection against the person in breach of copyright.
Apart from violation of copyrights and similar acts on intellectual property and pursuant to the Copyright Act and similar acts, it is forbidden to violate copyrights and similar acts on software rights on which the fima.com² portal is based and is considered to have taken place in particular by:
No information received through the use of fima.com2 portal shall be used for development, production or marketing of another portal not essentially different in its expression, or any other act in breach of copyright.
Contents published at fima.com2 portal may be copied or used only for non-commercial purposes and exclusively for personal use, with respect to all copyright and other rights and complied with the provisions of the Copyright Act and similar act.
Each User shall be personally responsible for any content he/she exchanges with other users.
FIMA Alfa d.o.o., as well as the FIMA business system members, do not supervise contents exchanged by the portal users, and shall therefore not guarantee for accuracy or quality of any such content.
In addition, all contents exchanged by the portal users do not reflect either FIMA Alfa d.o.o. attitudes of the FIMA business system members' attitudes, nor shall they be considered responsible for accuracy of information exchanged by users.
Neither FIMA Alfa d.o.o. nor the FIMA business system members are owners of the contents published or exchanged by fima.com2 portal guests. The User agrees that FIMA Alfa d.o.o., or the FIMA business system members use the contents for promotional and all non-commercial purposes.
When using fima.com2 portal contents it is strictly prohibited to:
The portal administrator may remove all unacceptable contents, or prevent any unacceptable actions, assessing, at the same time, the non-acceptance feature of the action, with a care of a prudent expert.
FIMA Alfa d.o.o. may, in case stated in the above paragraph, prevent the user publishing the unacceptable content or performing an unacceptable action from further use of fima.com2 portal contents.
When registering to fima.com2 portal services the User shall receive an e-mail with details on the user account - the username and the password.
The User shall keep the user account details and the password safe, and shall be solely responsible for all damage caused by unauthorized use of his/her user account or password.
The user shall, without delay, report to FIMA Alfa d.o.o. any unauthorized use of his/her user account or password.
Pursuant to provisions of the Personal Data Protection Act, all details entered into during the registration procedure, as well as other user details, shall not be available to third parties.
Upon request of a competent body, and to fulfil its legal liabilities, FIMA Alfa d.o.o. shall deliver the requested user details.
During the registration process the user can allow FIMA Alfa d.o.o. and the FIMA business system members to use the information provided during the registration process for the purpose of keeping internal records for possible business cooperation, contracting, business consulting and other possible models for cooperation related to their scopes of business services, including the use of information in marketing and similar campaigns, contacting via contact e-mail and offering all the products and services related to their scopes of businesses - by clicking the box provided in the registration form.
The permission to use the personal information, given as mentioned above, is regarded as a statement of permission to use the personal information for the purposes mentioned above.
In case that user does not give the permission to use the personal information, his/her personal information will be used exclusively in line to Article 13 of these Terms of Use.
Several links located on fima.com2 portal lead to other web pages and services. These pages, in general, are not supervised by the FIMA Alfa d.o.o. or the FIMA business system members, therefore they are they not and cannot be responsible for the contents of or further links on these pages.
Furthermore, incorporation of links into other FIMA Portal pages does not mean that the pages reflect attitude of FIMA Alfa d.o.o., or FIMA business system members, nor that they approve their content.
Neither FIMA Alfa d.o.o. nor the FIMA business system members shall be held responsible for any damage caused by advertising on fima.com2 portal, and all contractual relationship entered into by the User with the advertising party is to the User's own risk.
FIMA Alfa d.o.o. or FIMA business system members and the User shall try to solve all possible disputes arising from the use of fima.com2 portal by mutual agreement, in an amicable way, and if this is not possible the court of jurisdiction will be the court in Varaždin.
In case of dispute with regards to use of fima.com² portal or interpretation of these Terms of Use, Croatian law is the only applicable and the only source of Terms of Use is this document in Croatian language.
